ToggleWhat Is an E-Bike Accident?
An e-bike accident is any collision or incident involving an owned, rental, or shared electric bicycle that causes injury. It can involve an e-bike rider struck by a car, a pedestrian or cyclist hit by an e-bike, a rider injured by a road hazard, or someone hurt because of a defective electric bike.
Common e-bike accidents include:
- A rider struck by a car or truck
- A driver turning across an e-bike rider’s path
- A rider being “doored”
- A pedestrian or cyclist struck by an e-bike
- A crash caused by a pothole or unsafe road
- Brake, throttle or structural failure
- A poorly maintained rental or shared e-bike
Ontario treats a compliant e-bike as a power-assisted bicycle, so an e-bike injury claim shares some features with a conventional claim that a bicycle accident lawyer may take on, while raising additional legal and insurance issues.
What Counts as an E-Bike Accident?
Any incident in which the use, operation or condition of an e-bike contributes to an injury can potentially result in a claim. Another motor vehicle does not have to be involved.
Who Can Be Injured in an E-Bike Crash?
E-bike riders, pedestrians, cyclists, passengers, and other road users can suffer injuries. Consumers may also have claims involving defective batteries, brakes, throttles, or other components.

Why Does Insurance Experience Matter in an E-Bike Claim?
Insurance experience matters because insurers may investigate the e-bike’s specifications, modifications, speed, pedals, and insurance status as well as the rider’s conduct. My insurance-defence background helps me anticipate these.
Are E-Bikes Legal in Ontario? E-Bike Laws Explained
Yes. E-bikes are legal in Hamilton and across Ontario when they meet the requirements for a power-assisted bicycle (PAB) and are operated according to Ontario law.
Ontario’s PAB parameters include, in brief:
- Maximum 500-watt motor
- Maximum 32 km/h assisted speed
- Maximum 120 kg weight
- Working pedals
- Wheels at least 35 mm wide and 350 mm in diameter
- Required braking systems
- Motor and battery securely attached
- Properly insulated electrical terminals
- No illegal power or speed modifications
The e-bike must also be maintained in good working order. Riders must be at least 16 and wear an approved bicycle or motorcycle helmet.
You do not need a driver’s licence, licence plate, vehicle registration or mandatory automobile insurance for a compliant power-assisted bicycle. E-bikes are prohibited on 400-series highways and other controlled-access highways where bicycles are not permitted.
Ontario has proposed changes to its e-bike framework that could introduce different e-bike categories, so laws may change in the future.
Do You Need a Licence, Insurance, or a Helmet to Ride an E-Bike in Ontario?
You do not need a driver’s licence, registration, licence plate, or automobile insurance to operate a compliant power-assisted bicycle. You must wear an approved helmet.
What Happens if Your E-Bike Is “Out of Class” — Over 500W or 32 km/h?
An e-bike that exceeds Ontario’s legal limits or otherwise fails to qualify as a power-assisted bicycle may be considered a motor vehicle. That can trigger licensing, registration and insurance requirements and create serious issues in an injury claim.
Removing required pedals or illegally modifying an e-bike’s power or assisted speed can therefore have consequences beyond a traffic charge. If the classification of your e-bike is disputed after an accident, I can review its specifications, condition and modifications and determine how they may affect your claim.
What Causes E-Bike Accidents?
Drivers who fail to see or yield to riders cause many e-bike collisions. Common causes include:
- Left turns across a rider’s path
- Right hooks through bike lanes
- Vehicles pulling out of driveways
- Dooring
- Distracted driving
- Potholes, debris and unsafe cycling surfaces
- Speed differences on shared paths
- Distracted or impaired riding
- Inexperienced or underage riders
Some accidents have more than one cause.
What Are the Most Common Causes of E-Bike Accidents?
Failure-to-yield collisions, unsafe turns, and dooring are common scenarios, although road conditions, and rider conduct also cause crashes.
Where Do Most E-Bike Accidents Happen?
E-bike crashes can occur at intersections, in bike lanes, at driveways, on streets, and on shared paths. Hamilton’s bike network, waterfront and rail trails, and escarpment routes create different riding environments, including descents where e-bike speed may be higher than motorists or pedestrians expect.
Common E-Bike Accident Injuries
Riders have little protection from a collision, while an electric bicycle’s speed and weight can also cause significant injuries to pedestrians and conventional cyclists. Common injuries include:
- Traumatic brain injuries and concussions
- Spinal cord and back injuries
- Broken or fractured bones
- Facial and dental injuries
- Road rash
- Deep cuts and lacerations
- Internal injuries
Catastrophic and fatal injuries are unfortunately possible with e-bike accidents.
What Are the Most Common E-Bike Injuries?
Head injuries, fractures and upper- and lower-extremity injuries are commonly associated with e-bike crashes.
How Common Are E-Bike Injuries? E-Bike Accident Statistics
Research indicates that e-bike injuries have increased as ridership has grown:
- A 2025 Canadian study using data from 11 pediatric emergency departments found substantial growth in e-bike and e-scooter injuries among children and adolescents between 2011 and 2023.
- Only 30.8% of injured e-bike riders in that study were documented as wearing helmets.
- S. research has also found substantial increases in e-bicycle injuries.
- Head, facial and extremity injuries feature prominently in research involving serious e-bike crashes.
The research illustrates the growing injury concern associated with electric bicycles.
Who Is Liable for an E-Bike Accident in Ontario?
Liability depends on how the crash happened, and more than one person or organization may be responsible, including:
- A motorist
- An e-bike rider
- A rental or e-bike sharing company
- An e-bike manufacturer, distributor, or retailer
- A municipality or road authority
- Multiple parties whose actions contributed to the accident
One of the first questions I consider is whether a car or another motor vehicle was involved. That can determine whether Ontario’s Accident Benefits and automobile insurance framework apply.
Who Can Be Held Responsible for an E-Bike Injury?
The person or organization whose negligence caused the injury may be responsible.
Can I Claim if I Was Hit by an E-Bike as a Pedestrian?
Yes. A pedestrian injured by an e-bike may have a claim if the rider caused the collision by failing to yield, travelling at an unsafe speed, or otherwise failing to take reasonable care.
Compensation and Insurance After an E-Bike Accident in Ontario
If a car hits an e-bike rider, the injured person can generally seek Ontario Accident Benefits regardless of fault and may also have a tort claim against an at-fault driver. If no motor vehicle was involved, recovery may instead depend on negligence and available insurance coverage.
What Compensation Can I Recover After an E-Bike Accident?
Depending on the circumstances, an electric bike injury claim may include compensation for:
- Pain and suffering
- Past and future income loss
- Medical and rehabilitation expenses
- Future treatment and care
- Attendant care
- Housekeeping and home-maintenance needs
- Out-of-pocket expenses
- Certain losses suffered by family members
When a motor vehicle is involved, Accident Benefits may include income replacement, medical and rehabilitation, and attendant-care benefits. Ontario’s automobile insurance framework also includes rules that can affect tort damages, including a statutory deductible on certain pain-and-suffering awards.
What if I Was Partly at Fault, Out of Class or Not Wearing a Helmet?
Being partly at fault does not necessarily prevent you from making a claim, but your compensation may be reduced to reflect your share of responsibility. I can review the accident, the e-bike and the available insurance to determine what rules apply.
What to Do After an E-Bike Accident and How Your Lawyer Builds the Case
What you do after an e-bike accident can affect both your health and the evidence available for your claim. Here’s what I recommend:
- Get to safety and call 911 if necessary.
- Get medical attention, even if symptoms develop later.
- Obtain the driver’s name, insurance information, and licence plate.
- Photograph the scene, e-bike, vehicles, and injuries.
- Get witness names and contact information.
- Preserve the e-bike without repairing, altering, or returning it.
- Save GPS, app, and other electronic data.
- Do not give an insurer a recorded statement without consulting with a lawyer first.
An e-bike case can involve evidence that does not exist in an ordinary motor-vehicle claim. I may obtain GPS, speed, throttle or motor data, secure surveillance or doorbell footage, interview witnesses and arrange an inspection for defects or illegal modifications. Where necessary, I can also work with accident-reconstruction, engineering, and medical experts.
What Should I Do Immediately After an E-Bike Accident?
Get medical care and preserve evidence as soon as possible. If you suspect negligence may have caused the accident, consult with a Hamilton personal injury lawyer.
How Long Do I Have to File an E-Bike Accident Claim in Ontario?
Many Ontario personal injury claims are subject to a basic two-year limitation period from discovery of the claim. Shorter notice or procedural deadlines may apply to municipal and automobile insurance claims.
FAQs
These are questions I often get asked in my practice:
What Should You Do if an E-Bike Hits Your Car?
Stop safely, check for injuries, and exchange information with the rider. Call police or emergency services when required, photograph the scene, and obtain witness information without making assumptions about what caused the accident.
How Much Compensation Can You Get for a Bicycle or E-Bike Accident?
There is no standard amount. The value of an e-bike accident claim depends on the severity and duration of the injuries, lost income, treatment requirements, future costs, and the effect of the injuries on your life.
Are E-Bikes Legal in Ontario?
Yes. E-bikes are legal when they satisfy Ontario’s requirements for power-assisted bicycles and are operated according to provincial and applicable municipal rules.
Do You Need Insurance to Ride an E-Bike in Ontario?
A compliant power-assisted bicycle does not require automobile insurance. If the e-bike falls outside the legal requirements and is considered a motor vehicle, insurance requirements can change.
Who Is Liable for an E-Bike Accident?
Liability may rest with a driver, e-bike rider, rental company, distributor, retailer, municipality, or several parties.
What Should I Avoid Saying to an Insurance Adjuster?
Do not guess about speed, distance or fault, minimize your injuries, or speculate about the condition of the e-bike. You should also understand why a recorded statement is being requested before agreeing to provide one.
How Long Do I Have to File an E-Bike Accident Claim in Ontario?
The general limitation period for many Ontario personal injury claims is two years from discovery, but shorter deadlines can apply.
